COVID-19 and the Rise of Telemedicine

 

The Massachusetts Health & Hospital Association is proud to present a webinar series on the expanded opportunities for Massachusetts providers to treat patients via telemedicine during the COVID-19 pandemic. Please join us for Part 1 of this multi-webinar series, which will provide a high-level overview of the federal and state waivers that have enabled providers to increase their utilization of telemedicine, the “nuts and bolts” of the telehealth regulatory landscape, and best practices when building a telemedicine program.

Learning Objectives

Understand telemedicine coverage and reimbursement under the various federal and state COVID-19 telemedicine waivers, and how the current landscape compares with normal federal and state law.

Understand COVID-19 waivers regarding HIPAA and privacy issues during the COVID-19 pandemic.

Explore common questions regarding billing Medicare for telemedicine during the pandemic.


FACULTY:

Amy Joseph, Partner, Hooper Lundy and Bookman, PC

Amy Joseph co-founded Hooper Lundy & Bookman’s Boston office in 2017, and is currently the co-chair of the firm’s Business Department and its Academic Medical Center/Teaching Hospital Working Group. Amy advises health systems, academic medical centers, and a wide variety of other healthcare providers, as well as a number of health information technology companies in the digital health space, including telehealth platforms and artificial intelligence solutions. A significant portion of her practice is focused on fraud and abuse compliance, including both providing proactive counseling on proposed arrangements and conducting internal investigations. In addition, she frequently counsels clients on information privacy and security compliance with federal and state privacy laws, including HIPAA, 42 CFR Part 2, and the California Consumer Privacy Act. Amy is co-author of AHLA’s The Stark Law: Comprehensive Analysis and Practical Guide, Sixth Edition, co-author of a chapter of AHLA’s Best Practices Handbook for Advising Clients on Fraud and Abuse Issues, and co-author of the telemedicine chapter of ABA’s Physician Law: Evolving Trends & Hot Topics. She regularly presents and writes on these topics.

Jeremy Sherer, Associate, Hooper, Lundy and Bookman, PC

Jeremy Sherer is a healthcare attorney specializing in digital health matters and co-chair of Hooper, Lundy and Bookman’s Digital Health Task Force. He counsels healthcare providers and suppliers, including hospital systems, provider organizations, national telehealth platforms and digital health startups on issues involving regulatory compliance, transactions and innovative business arrangements. Jeremy’s digital health experience includes counseling clients on state-level scope of practices issues (e.g., licensure, informed consent, practitioner-patient relationship establishment), Medicare, Medicaid and commercial reimbursement, corporate practice of medicine issues and e-prescribing (including controlled substances), as well as healthcare technology transactions. He also advises clients on compliance with fraud and abuse laws, including federal and state anti-kickback and self-referral laws, provider contracting, value-based care, and regulatory compliance issues. Jeremy frequently speaks on digital health matters across the country, and is a member of the Legal Resource Team at the Center for Telehealth and e-Health Law (“CTeL”). He was named one of “12 Health IT Attorneys You Should Know” by Health Data Management in 2017, and received the American Bar Association Health Law Section’s “Emerging Young Lawyer in Health Care” award in 2019. He has also been named a “Rising Star” in healthcare law by Super Lawyers since 2017.
